Effective Date: 27 August 2026

These Terms & Conditions govern the use of [Company Name] services, including tuk-tuk rentals, self-drive rentals, tuk-tuk rides, tours, transportation services, website bookings, and related services.

By making a booking or using our services, you agree to these Terms & Conditions.


1. Definitions

“Company” means Tuk Took and Ride.

“Customer” means the person making or using a booking.

“Vehicle” means the tuk-tuk or other vehicle supplied by the Company.

“Rental Period” means the period stated in the booking confirmation.

“Booking” means a reservation made for a rental, ride, tour, or other service.

“Security Deposit” means any deposit required before a vehicle is provided.

“Agent” means an approved travel agent, hotel, tour operator, affiliate, or referral partner.


2. Eligibility

For self-drive rental, customers must satisfy all applicable legal and Company requirements.

The customer may be required to provide:

  • Valid passport or identification
  • Valid driving licence
  • International Driving Permit or other legally recognised documentation where required
  • Contact details
  • Emergency contact information
  • Other documents reasonably requested by the Company

The Company may refuse a rental if the customer cannot demonstrate the required legal authority to drive the vehicle.


3. Driving Licence Requirements

The customer is solely responsible for ensuring that their driving licence and any required international documentation are valid for operating the vehicle in Sri Lanka.

The Company may request to inspect original documents.

Digital photographs or copies may not be accepted where original documents are legally or operationally required.


4. Booking Confirmation

A booking becomes confirmed only after the Company’s required booking conditions have been fulfilled.

A booking confirmation may include:

  • Customer information
  • Vehicle
  • Pickup location
  • Return location
  • Rental period
  • Price
  • Deposit
  • Additional services
  • Special conditions

Customers should check all information immediately and notify us of any errors.


5. Rental Price

The rental price may depend on:

  • Vehicle type
  • Rental duration
  • Season
  • Pickup location
  • Drop-off location
  • Additional services
  • Optional extras

Unless otherwise stated, additional products or services may incur separate charges.


6. Optional Extras

Optional extras may include:

  • Child seats
  • Additional equipment
  • Insurance-related products
  • Driver services
  • Tours
  • Accessories
  • Delivery/pickup
  • Additional mileage
  • Other services

Charges for optional extras will be communicated before or during booking where reasonably possible.


7. Travel Agent and Affiliate Bookings

We may work with travel agents and affiliate partners.

Where a customer books through an agent:

  • The agent may receive a commission.
  • The booking may be tracked through an affiliate/reference code.
  • The Company may communicate directly with the customer regarding service delivery.
  • Agent commissions do not normally increase the customer’s contractual obligations to the Company.
  • Special agent rates or discounts may be subject to separate agreements.

8. Pickup

Customers must arrive at the agreed pickup location at the agreed time.

The customer may be required to present:

  • Passport/ID
  • Driving licence
  • Required driving documentation
  • Booking confirmation
  • Payment/deposit confirmation

Failure to provide required documentation may result in the rental being refused.


9. Vehicle Inspection

Before accepting the vehicle, the customer should inspect it and report visible:

  • Scratches
  • Dents
  • Cracks
  • Mechanical issues
  • Missing equipment
  • Tyre damage
  • Windscreen damage
  • Other defects

The condition of the vehicle may be recorded through:

  • Photographs
  • Videos
  • Inspection forms
  • Digital records

By accepting the vehicle, the customer acknowledges its recorded condition unless defects are reported immediately.


10. Customer’s Responsibility for the Vehicle

The customer must:

  • Operate the vehicle carefully
  • Follow Sri Lankan traffic laws
  • Lock the vehicle when unattended
  • Keep keys secure
  • Use the vehicle only for lawful purposes
  • Follow manufacturer and Company instructions
  • Report accidents and damage promptly

11. Prohibited Use

The vehicle must not be used:

  • For illegal activities
  • For racing
  • For speed competitions
  • To transport prohibited goods
  • To carry more passengers than legally permitted
  • While the driver is under the influence of alcohol or drugs
  • In dangerous or abusive conditions
  • For commercial transportation without permission
  • By an unauthorised driver
  • Outside permitted areas where geographical restrictions apply

12. Additional Drivers

Only drivers approved by the Company may operate the vehicle.

An unauthorised person driving the vehicle may constitute a serious breach of the rental agreement.

The customer may be responsible for all resulting costs, losses, damages, fines, and liabilities.


13. Traffic Laws and Fines

The customer is responsible for complying with all applicable traffic laws.

The customer may be responsible for:

  • Speeding fines
  • Parking fines
  • Traffic violations
  • Towing charges
  • Police penalties
  • Road tolls where applicable
  • Other penalties caused by the customer’s use of the vehicle

14. Accidents

In the event of an accident, the customer must:

  1. Stop safely.
  2. Check whether anyone requires medical assistance.
  3. Contact emergency services where necessary.
  4. Notify the Company as soon as reasonably possible.
  5. Contact the police where required.
  6. Obtain relevant information from other parties.
  7. Take photographs/videos where safe.
  8. Avoid admitting legal liability on behalf of the Company.

Failure to report an accident promptly may affect the customer’s responsibilities under the rental agreement or applicable insurance arrangements.


15. Vehicle Damage

The customer may be responsible for damage caused by:

  • Negligence
  • Reckless driving
  • Misuse
  • Unauthorised driving
  • Driving under the influence
  • Incorrect fuel
  • Ignoring warning lights
  • Off-road use without permission
  • Improper loading
  • Lost keys
  • Lost equipment
  • Intentional damage

The Company may recover reasonable repair, recovery, administrative, or related costs where applicable.


16. Breakdown

If the vehicle breaks down, the customer should immediately contact the Company.

The customer should not arrange major repairs without prior approval unless necessary to protect life or prevent significant additional damage.

Where reasonable, the Company will arrange assistance.


17. Fuel

The vehicle will be supplied with fuel according to the Company’s stated fuel policy.

Unless otherwise specified:

  • Customers are responsible for fuel consumed during their rental.
  • The vehicle should be returned according to the agreed fuel condition.
  • Additional fuel charges may apply if the vehicle is returned with insufficient fuel.

18. Mileage

Mileage restrictions, if any, will be stated during the booking process.

Where unlimited mileage is offered, reasonable-use restrictions may still apply.


19. Late Return

Customers must return the vehicle at the agreed time and location.

Late returns may result in additional charges.

If the customer expects to be late, they must contact the Company as soon as possible.


20. Early Return

Returning a vehicle early does not automatically create an entitlement to a refund.

The Company may consider individual circumstances at its discretion.


21. Security Deposit

The Company may require a security deposit before providing a vehicle.

The deposit may be used to cover legitimate amounts owed by the customer, including:

  • Damage
  • Missing equipment
  • Cleaning
  • Fuel
  • Traffic fines
  • Recovery
  • Late return
  • Other contractual charges

22. Cleaning

Customers must return the vehicle in a reasonably clean condition.

Additional cleaning charges may apply for:

  • Excessive dirt
  • Food contamination
  • Spilled liquids
  • Vomit
  • Smoking-related contamination
  • Damage caused by animals
  • Other unusual contamination

23. Smoking

Smoking inside the vehicle may be prohibited.

Where smoking is prohibited, the customer may be charged for:

  • Deep cleaning
  • Odour removal
  • Damage to interior components

24. Pets and Animals

Animals may only be transported with prior approval and in accordance with applicable safety requirements.

The customer may be responsible for any cleaning or damage resulting from animals.


25. Passenger Safety

Customers must comply with all applicable passenger and safety requirements.

The number of passengers must not exceed the legally permitted or Company-approved capacity.


26. Tuk-Tuk Rides and Tours

For driver-operated rides and tours:

The Company may determine or modify routes where reasonably necessary because of:

  • Traffic
  • Weather
  • Road closures
  • Safety concerns
  • Government restrictions
  • Local conditions

The Company will make reasonable efforts to provide the agreed service.


27. Tour Duration

The advertised tour duration represents the expected service period.

Actual timing may vary due to:

  • Traffic
  • Weather
  • Customer delays
  • Road conditions
  • Local events
  • Safety considerations

28. Driver Conduct

Drivers are expected to behave professionally and respectfully.

Customers should also treat drivers respectfully.

Abusive, threatening, violent, discriminatory, or unsafe behaviour may result in termination of the service without refund where permitted by law.


29. Customer Conduct

Customers must not:

  • Threaten employees
  • Damage Company property
  • Harass drivers
  • Engage in illegal activity
  • Provide false information
  • Attempt to circumvent payment
  • Misuse booking systems
  • Abuse promotional offers

The Company may cancel a booking where necessary to protect customers, employees, vehicles, or property.


30. Website Use

Customers must not:

  • Attempt to hack the website
  • Introduce malware
  • Circumvent security systems
  • Access unauthorised areas
  • Submit fraudulent information
  • Interfere with website operation
  • Use automated systems to abuse the booking platform

31. Online Booking Errors

We make reasonable efforts to ensure pricing and availability information is accurate.

However, technical errors may occasionally occur.

If a significant pricing or availability error occurs, we may contact the customer and provide the option to:

  • Confirm the corrected booking; or
  • Cancel the affected booking and receive an applicable refund.

32. Promotional Offers

Promotional discounts may:

  • Have expiry dates
  • Be limited to selected vehicles
  • Be limited to specific dates
  • Require a minimum rental period
  • Not be combined with other promotions

The Company may withdraw or modify promotions where reasonably necessary.


33. Affiliate/Agent Discounts and Commissions

Where applicable, agents may receive a commission based on qualifying bookings.

The Company may determine which products qualify for commission.

For example, unless otherwise agreed in writing, commission may apply only to the base tuk-tuk rental price and not to:

  • Add-ons
  • Insurance products
  • Licences
  • Delivery fees
  • Optional extras
  • Taxes
  • Other separately identified charges

The exact commission arrangement will be governed by the relevant agent agreement.


34. Insurance

Where insurance is provided or offered, the applicable insurance terms, exclusions, excesses, limitations, and conditions will apply.

Customers should carefully review the insurance terms before using the vehicle.

Insurance does not necessarily cover:

  • Intentional damage
  • Drunk driving
  • Unauthorised drivers
  • Illegal use
  • Negligent behaviour
  • Certain types of tyre/windscreen damage
  • Lost keys
  • Personal belongings
  • Other exclusions specified by the relevant insurance policy

35. Personal Belongings

Customers are responsible for their own belongings.

The Company is not responsible for lost, stolen, or damaged personal property except where liability cannot legally be excluded.

Customers should not leave valuables unattended in a vehicle.


36. Company Liability

To the extent permitted by applicable law, the Company will not be responsible for indirect or consequential losses arising from:

  • Travel delays
  • Missed flights
  • Missed connections
  • Lost bookings with third parties
  • Personal inconvenience
  • Loss of personal property
  • Delays caused by traffic or weather

Nothing in these Terms excludes liability that cannot legally be excluded.


37. Force Majeure

The Company will not be responsible for failure or delay caused by circumstances beyond its reasonable control.

These may include:

  • Natural disasters
  • Floods
  • Severe weather
  • Government restrictions
  • Civil disturbances
  • Road closures
  • Strikes
  • Epidemics/pandemics
  • Major accidents
  • War
  • Terrorism
  • Infrastructure failures
  • Significant transport disruptions

38. Cancellation or Refusal of Service

The Company may refuse or terminate a rental/service where reasonably necessary because:

  • Required documents are missing
  • The customer is legally unable to drive
  • The customer appears intoxicated
  • The customer provides false information
  • The vehicle would be used unlawfully
  • The customer behaves abusively
  • Safety requirements cannot be met
  • Payment requirements are not satisfied

39. Complaints

Customers should first contact the Company regarding any complaint.

A complaint should include:

  • Booking number
  • Date of service
  • Customer name
  • Description of the issue
  • Supporting photographs/documents where applicable

The Company will make reasonable efforts to investigate and respond.


40. Governing Law

These Terms & Conditions shall be governed by the applicable laws of Sri Lanka, unless another governing law is required by applicable law or specifically agreed in writing.

Any dispute will be addressed through the appropriate legal or dispute-resolution mechanisms available under applicable Sri Lankan law.


41. Changes to Terms

The Company may update these Terms & Conditions from time to time.

The latest version will be published on the website.

Bookings already confirmed may continue to be governed by the terms applicable at the time of booking, unless a change is required by law or agreed with the customer.


42. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.


43. Entire Agreement

The booking confirmation, applicable pricing, rental agreement, specific booking conditions, and these Terms & Conditions together form the agreement between the Company and the customer, subject to applicable law.
